1. Acceptance of Terms

By installing, accessing, or using the EngageAI extension ("Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the Service.

2. Description of Service

EngageAI is a Google Chrome extension that uses artificial intelligence to generate reply suggestions for comments on YouTube videos. The Service includes:

• Contextual reply generation using AI (GPT)
• Credit system based on your subscription plan
• Integration with the YouTube platform

3. Plans and Payments

We offer the following plans:

• Free: 10 credits per month, at no cost
• Creator: 200 credits per month, $4.90/month
• Pro: 1,000 credits per month, $9.90/month

3.1 Payments

Payments are processed by Stripe. By subscribing to a paid plan, you authorize recurring monthly charges until you cancel.

3.2 Cancellation

You may cancel your subscription at any time through the extension. Access to the plan continues until the end of the current billing period.

3.3 Refunds

We do not offer refunds for partially used periods. In exceptional cases, please contact our support team.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these terms. The following is prohibited:

• Using the Service to generate spam or abusive content
• Attempting to circumvent the credit system
• Sharing your account with third parties
• Using the Service to violate YouTube's Terms of Service
• Generating content that is illegal, offensive, defamatory, or infringes on the rights of others
• Reverse engineering or attempting to access our systems without authorization

5. Intellectual Property

EngageAI, including its brand, logo, code, and design, are our exclusive property. Use of the Service does not grant you any ownership rights over our content or technology.

AI-generated replies are your responsibility once published. You retain all rights to the content you create or publish.

6. Disclaimer of Warranties

The Service is provided "as is", without warranties of any kind, express or implied. We do not guarantee that:

• The Service will be uninterrupted or error-free
• Generated replies will always be appropriate or accurate
• The Service will meet all your specific needs

7. Limitation of Liability

In no event shall we be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the Service, including but not limited to:

• Loss of profits or revenue
• Reputational damage
• Loss of data
• Actions taken by YouTube against your account

8. Changes to the Service

We reserve the right to:

• Modify or discontinue the Service at any time
• Change plan prices (with 30 days' prior notice)
• Update these Terms of Service

Significant changes will be communicated by email or through the extension.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, if you violate these Terms of Service.

You may terminate your account at any time by contacting our support team.

10. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the State of Delaware.

11. General Provisions

• If any provision of these terms is found to be invalid, the remaining provisions shall remain in effect
• Our failure to exercise any right does not constitute a waiver
• These terms constitute the entire agreement between you and us
